This is to notify all the taxpayer that the Department of Revenue & Customs has streamlined the existing procedures on categorization of delinquent taxpayer. All concerned are hereby requested to take note of the following procedures in addition to what is considered in the Income Tax Act, 2001 and the Rules thereof.

Information to taxpayers after tax assessment:

• Tax payer will be informed in writing by the respected RRCO on their obligation to pay 24% of penal interest on the additional tax raised along with the time limit to appeal after the demand notice is issued
• Failure to appel within 30 days from the date of issue of the demand notice shall be construed as tax payer foregoing right to appeal as granted under section 45.1, Chapter 7, General provision of the income tax act of the Kingdom of Bhutan. 2001
• RRCO will issue two reminder letter after 30 days from the issue of demand notice with the time gap of one month between each reminder letter if the tax raised remain unsettle.
• Installment benefits will be extend to settle the taxes raised if the RRCO deams it necessary
• Failure to comply with the first reminder letter would result to withholding of tax clearance certificate of sister concerns. Import and Exports, if any will be also stopped.

Categorization of delinquent tax payers

• The tax payer will be categorized as “delinquent tax payer” if a tax payer fails to comply with the second reminder letter. The case will then be forwarded to DRC HQ for necessary action.
• The DRC HQ will publish the list of delinquent taxpayers in the media requesting for early settlement of the taxes in arrears.
• The case will be forwarded to the legal unit, MoF for legal recovery if the delinquent taxpayer fails to respond within the due dates mentioned in the announcement
